Magetkin Intellectual Property Policy
Magetkin offers an online platform where users can design and sell custom T-shirts and merchandise. To protect creators and maintain a fair marketplace, we strictly prohibit the creation or sale of products that infringe on the intellectual property rights of others, including copyrights, trademarks, and related rights.
If you believe someone has violated your intellectual property rights on Magetkin, please follow the steps outlined below.
A. Reporting Intellectual Property Infringement
- Content Removal: Upon receiving a valid infringement notice, Magetkin will, in good faith, remove or disable access to the infringing content.
- Repeat Violations: Accounts with repeated offenses will be permanently terminated.
To report an infringement, please submit a notice to our Designated Agent with the following details:
- Identification of the infringed intellectual property (e.g., copyright or trademark) with registration numbers, if applicable.
- Details of the infringing content, including:
- A description of how the content infringes your rights.
- The content’s location on the Magetkin platform (URL or specific page).
- Your contact information: full name, mailing address, phone number, and email.
- A sworn statement, under penalty of perjury, that the disputed content is being used without authorization.
- A sworn statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf.
- An electronic or physical signature of the rights holder or their representative.
B. After Receiving an Infringement Notice
- Content Removal: Magetkin will promptly remove or disable access to the reported content.
- Notification to the User: The content owner will be informed of the action taken.
- Repeat Offenders: Users with multiple infringement reports will have their accounts permanently terminated.
C. Submitting a Counter-Notice
If you believe your content was mistakenly removed or that you have the right to use the material, you can file a counter-notice with the following details:
- Identification of the removed content, including where it appeared before removal.
- A sworn statement, under penalty of perjury, that the content was removed due to error or misidentification.
- Your contact details: full name, mailing address, phone number, and email.
- A statement consenting to the jurisdiction of the Federal Court in your district (or Magetkin’s location if outside the USA).
- Your electronic or physical signature.
If a counter-notice is received, Magetkin may inform the original complainant and, unless legal action is pursued, the content may be restored within 10–14 business days at Magetkin’s discretion.
Important: Under Section 512(f) of the DMCA, anyone knowingly misrepresenting a claim of infringement may be liable for damages, including legal fees.
